License Agreement for Personal Use of Images
Terms and Conditions of Use
World View Images grants to you a NON-EXCLUSIVE, NON-TRANSFERABLE right to use PURCHASED IMAGES perpetually over all mediums with the following understanding, limitations and restrictions.
(a) Copyright and Ownership - It is understood that the purchase of images from World View Images is ONLY a LICENSE TO USE images and in no way represents a transfer of ownership of the image it self. Copyright and ALL other rights remain the sole property of World View Images.
(b) Backups/Public Servers - Downloaded images may be backed up or archived to a server for personal use only. Backups may only be used in the case where the original image file has become defective. Other copying or storage of images for distribution to others is not permitted whether the intent may be for sharing or for resale. You may not store images on a public server or on any web-site for public download.
(c) Usage - Images may be utilized in whole or part, modified or altered as necessary for your design, over multiple non-commercial projects, perpetually, in any electronic medium and print, without any further royalties due to World View Images, except where utilization of image(s) violates prohibited usage described below.
(d) Credit - Giving credit to World View Images is not required but very much appreciated. Where it does not interfere with your design or where other images are receiving credit please credit "worldviewimages.com".
(e) Termination - Should the user at any time fail to comply with the terms of this agreement the license for use of the images shall be terminated. Should this occur, the user agrees to cease using the images for any purpose and destroy all copies of images purchased from World View Images. The user must confirm in writing to World View Images that these actions have indeed been taken.
(f) Warranties - World View Images guarantees that the downloaded images, will be free from defects for a period of 30 days. Should the product prove to be defective you will be given the opportunity to download the image again. If for any reason the file itself is found to be defective, World View Images, upon notification, will rescan the image and replace the defective file within one business day or refund the full purchase amount. It is understood that images are provided without any guarantee to their effectiveness or suitability for any specific purpose. UNDER NO CIRCUMSTANCES will World View Images be held in any way responsible or liable to you for any damages that may occur due to the perceived or real unsuitability of the image.
(g) Indemnification - You agree to indemnify World-View Images against all claims or liability asserted against World View Images in any disputes that may arise out of a breach of this agreement.
Prohibited Use: It is understood that you are NOT permitted to:
(1) Use any image or derivative work for any pornographic, libelous or fraudulent purpose.
(2) Resell or transfer the right to use, sub-license, or in any way distribute images, whether in whole or part, modified or altered, as part of a stock image collection or similar product where it is expressly stated or otherwise implied that the purchaser or recipient is gaining the legal right to use the image in a new product or design.
(3) Remove trademark, copyright or other file information that may be associated with or embedded in the file.
(4) Use images with recognizable faces for the endorsement of a product or philosophy, unless a model release is specifically associated with the image.
(5) Display images over any publicly accessible electronic medium at a resolution greater then 640X480 pixels, (72 dpi)
(6) Use image(s) purchased for personal use, for any commercial purpose or financial gain.
(7) Use image(s) purchased for personal use on any web-site or blog, other then for personal use.
(8) Use image(s) purchased for personal use in any project that is duplicated, and distributed, regardless of whether or not the project is for profit.
